1. Who we are

LotPay makes online payment portals for car dealerships and landlords (we call them "businesses" below). Each business gets its own portal where its customers can see what they owe and pay online.

LotPay is owned by Andrew Pressley and is based in Oxford, Alabama. You can reach us by email at brock@lotpayportal.com or by text at (256) 453-0894.

These terms cover lotpayportal.com and every LotPay payment portal. By using them, you agree to these terms, our Privacy Policy and our Refund Policy.

2. Your portal account

3. Paying through LotPay

4. The online fee

5. Refunds and charges you don't recognize

Refunds are covered in our Refund Policy. If you see a charge you don't recognize, contact the business or us first. Most problems, like a payment made twice, can be fixed quickly. You can still dispute a charge with your card issuer.

6. Using the portal the right way

You agree not to use someone else's account without permission, pay with a card you aren't allowed to use, try to break into, overload or copy the portal, or use it for anything illegal. We may suspend access to protect you, the business or LotPay.

7. Emails and texts

The business may send you payment receipts, reminders and account messages through LotPay by email or text message. Message and data rates may apply. If you don't want texts, tell the business.

8. When the portal isn't available

We work to keep portals running 24 hours a day, but they can go down for maintenance or for problems outside our control. If you can't pay online, pay the business another way. Your due dates are set by your agreement with the business, not by LotPay.

9. Businesses that use LotPay

Businesses also sign a LotPay service agreement. If that agreement and these terms disagree, the service agreement controls for the business.

10. Disclaimers and limits

LotPay is provided "as is." To the extent the law allows, LotPay is not responsible for indirect, incidental or consequential damages, or for a business's own records, decisions or actions. To the extent the law allows, our total liability for any claim about the portal is limited to the greater of $100 or the online fees you paid in the 12 months before the claim.

11. Governing law

Alabama law governs these terms. Any dispute will be handled in the state or federal courts for Calhoun County, Alabama, unless the law requires otherwise.

12. Changes to these terms

We may update these terms. When we do, we'll change the date at the top of this page. The updated terms apply from that date on.
